Everything is negotiable. They (the agency) want to protect themselves and place the burden on your shoulders. You want to protect yourself and place the burden on their shoulders. Unfortunately, the agreement the agency seems to have negotiated with the contracting company alleviates them (the company) of any burden.

If the agency is unwilling to negotiate, then politely say good bye and move on to the next opportunity. If they are willing to negotiate, then negotiate...come to a middle ground. If the agree to negotiate, but you still can't come to an agreement that you are satisfied with, then politely say good bye and move on to the next opportunity. There are plenty of fish in the sea for both parties.
