Hello Everyone,

Perhaps some of you remember my questions late last
year regarding a new boss that did not understand my
position and my various concerns. Well, things did
not turn out well and I was hoping that others in the
technical publications field might have run into
similar situations and how they dealt with this.

Things have moved along, assignments were given, and I
fulfilled what was asked of me delivering the same
level of quality work that I have been doing since I
started with the company back in July of 2005.

Out of the clear blue, I get called to a meeting this
morning, am told the quality of the project I
completed at the end of January was not good enough,
and am given the option to either be terminated and be
paid through the end of the day or sign a resignation
letter and get paid through the end of the month! I
was shocked!

Well, after consulting with my state's (TX) workforce
commission I found out that when a resignation option
is offered in this manner with a termination as well
it is a termination in the eyes of the state agency.
Further, this places the burden of proof on the
employer to prove misconduct. The proof the state
agency is looking for are written reprimands, written
reviews, written warnings, etc. with my signature
acknowledging receipt of them.

Since starting there I have not had so much as a
single warning, review, etc. in writing.

In light of this information and the fact I have a
witness to being given the choice by my manager, I
signed the resignation letter so I could get the extra
week's worth of wages.

While I don't really care to get my job back I do want
to file for unemployment, but I have never been
treated so horribly by an employer in my entire life.

Any thoughts on handling this properly?
