Robert B. Kennedy contacted me privately to point out that the part of the
disclaimer about the viruses was not likely to be an option. That being the
case, how about the following rewording: "We scan all our files and messages
for viruses, and recommend that you do so too." That reassures rather than
alarms the reader, states that you're practicing due diligence*, and earns
you bonus points for providing useful advice rather than washing your hands
of any potential problems.
* If you're not, make a strong point that you'd better start now! Several
companies have recently been burned quite badly in the PR department by
claiming one thing in their Web privacy policy, and doing something else
entirely. Quite apart from any legal issues, just imagine the damage you'll
do to your company's reputation if a virus does get released with your name
on it! You may not end up in court, but you can bet you'll lose customers.
