(2) The prospects don't need to be responsible for the info because unless they deliberately try to download things (which they can do), all they're doing is reading things as they're rendered on my website. So nothing for the client to be responsible for except for what's in their brain. And if their brain is compromised, then no concerns, really :-).

Yes, but then they wouldn't be unknowing that they are responsible for the info -- they will have deliberately decided to take the info off my website (which yes, is hosted on my ISP's server, but that's acknowledged and allowed by clients in the same way that online backup is acknowledge and allowed per my contracts). I understood the earlier point to be a concern that somehow a portfolio reader might be worried that they'd be responsible for info that all they'd done is read, which I do not believe is a concern in this case.

I think as a group (all us tech writers), we've really been cowed by client demands and statements that everything in the world is proprietary and confidential. But assuming that contract language actually addresses these issues, that permission is obtained for posting specific info, that we as writers act responsibly and really do take care to not share things that clearly are IP, and that a click-through NDA (that's been vetted by one's own legal counsel) is used, we really are more than adequately covered.

And that just has to be acceptable if those same clients are the ones demanding that we provide an online portfolio.

Just my ideas of course, not the words of a lawyer, and YMMV, etc., etc.
