But in the absence of legal restrictions, so is the right to make personal habits
a criteria for employment.

This is actually a potentially huge employment ethics issue. Many companies
already require drug screenings, but as genetic screening technology advances,
the same sample that tells prospective employers whether you use drugs (including
nicotine) will also tell them whether your genetics make you a higher risk for any
number of potential health issues. In the absence of restrictions on the use of
such factors in hiring decisions, it is possible that someday you may be denied a
job because your DNA marks you a higher risk for some inherited health issue.

This is going far afield for this list, so I'm going to bow out of this one here.

The idea of a Bill of Rights worried some of the founders greatly. They feared that, by listing rights not to be infringed by the government, rights that were not listed might be subject to government interference because such interference was not specifically prohibited. The Ninth Amendment was written in an attempt to preclude such abuse.
