While I agree that it is always better to get a written contract. I
disagree with your statement that a verbal agreement is not binding. In
most states verbal agreements are fully enforceable except for certain
specific exceptions. You are confusing proof of existence with proof of
terms. You should consult a local lawyer for clarification.
