Invasion of privacy.

I don't see how what someone does in their own time has to do with their
dedication to a company. I think you are lumping recreational users who have
a conscious decision to use drugs outside of work on their own time with
people who have a problem.
If the only way that a company thinks it can determine that someone won't be
a "good" employee is via a drug test, then I'd say your interview and
reference checking isn't very good.
