For the benefit of those on the list not in CA, here is how
the state defines "professional" exempt employees:

http://www.dir.ca.gov/dlse/Glossary.asp?Button1=P#professional%20exemption

There is additional language specifically for an "employee
in the computer software field:"

http://www.dir.ca.gov/dlse/Glossary.asp?Button1=E#employee%20in%20the%20computer%20software%20field

I'm not familiar with the specifics of the Hoenemier lawsuit,
and am curious to see whether it's based on the argument
that she was not exercising "discretion and indepent judge-
ment" in the performance of her duties, or more broadly
that as a tech writer she was not doing "work requiring
knowledge of an advanced type" Sun's response appears
to claim that she was not doing either satisfactorily.
