You are confusing the world of criminal law (crimes, indictments,
prosecutors, imprisonment as a potential penalty, etc.) with the
world of civil law (torts, contracts, plaintiffs rather than prosecutors,
and nothing but monetary damages). One does not need to commit
*any* criminal act in order to be found liable in a civil suit brought
by an aggrieved plaintiff. In some types of civil matters--like slander
and libel--intent is an important element, but in many types of civil
matters simple negligence is enough. But in any event there is no
crime involved in slander or libel. You can be sued but not prosecued,
and you'll never be sent to prison for it no matter what the verdict.

Agreed, we are a litigious society, but the burden of proof would be on the
recruitment agencies. They would have to prove a) a post to this website
was actually a crime and b) the damages from that crime. I'm assuming - in
this hypothetical situation - that a recruitment agency would argue that the
information in the post was false, and that this information reduced their
business/prevented them from doing business/ruined their reputation.

The burden of proof is on them, and it wouldn't be easy to prove. The
plaintiff better have some well-funded legal guns.

The feedback contained in this thread has been very valuable. I hadn't
thought about recruitment agencies posting glowing reviews about themselves.
Personally, I think a site like this would be of value.

I worked for a recruitment agency that didn't do direct deposit, nor did
they mail or deliver paychecks. To get paid, one had to drive to their
corporate office. Had I known that ahead of time, I probably wouldn't have
done business with them.
