Agreed. I initially raised the legality issue in response to a poster who described a three-day writing assignment and was only responding to your comment about not exploiting the applicants' work.
I've taken tests and given tests, always well within the bounds of the rules; and I've found a well constructed test to be helpful in sorting out applicants on a number of criteria--all stories I've told here before.
