I think you are both right, rephrasing the note would allow you to detail
what they CAN do, and rather than a negative tone, you then simply convey
the limitations that are inherent in the product (and my understanding of
your topic would suggest that it's aimed at tech-savvy users, to a degree
anyway.. Right?)

For example:

"Note: When building complex queries the criteria is not stored until
[insert the action required to store the criteria]. To create a complex
query you must first create an activity (see page 23)."
