I hate to say it, but the rules really boil down to "What-ever the agent you
encounter crossing the border thinks they are."

I've been questioned and had trouble going down to our plant in Plattsburgh just
to validate procedures, yet to travel to NYC for 6 weeks to train clients not a
single question.

The ONLY people to ask are US customs and immigration. Put your intended purpose
in writing and ensure you get a written response with the requirements.
