Two points, one minor, one major:

= All contracts are verbal, that is, composed of words. Some are oral,
that is, spoken, while some are written, that is, well, written.

= As for collecting on bad contracts, I agree that not being paid is one
of the risks of contracting and that carefully qualifying a prospect is
one of the best ways to prevent it, but I haven't been ready to let go
when it occurs.

There are numerous ways to proceed against a client who won't pay you.
Whether they're worth doing in a given situation depends on many
variables, but they include Small Claims Court, complaints to Better
Business Bureau and local law enforcement (many consumer desks at local
district attorneys also take complaints from small vendors like us),
collection agencies, and posting accounts of the problem on Internet
writer forums. I'm a member of the National Writers Union, so I just
threatened to file a grievance with the union and the client paid.
