Tricky question, subtle answer. Its firmware if IT IS STORED ON A BOARD or
IN A CHIP. So, Win2k, comes on a CD, gets installed onto the HARD DISK, is
NOT firmware. A CD sent out to a pokie machine owner to be loaded into the
pokie machine's chips IS firmware. A new chipset is firmware.

IBM make microcode patches for their mainframe cpu's. These are distributed
via CD. The CD's contents get loaded directly onto the mainboards. The CD,
as well as the newly populated chips, are firmware.

The more I think about it, the more bizarre it gets. I think I'm going to
just use the term "firmware" and keep it as simple as possible, but knowing
the guys that review the document, someone's going to raise a fuss over this
and try to make it more complicated than it is.
