According to the article, the Terms of Service grant MS an unconditional "r
ight to exploit any proprietary rights in such communication, including but
not limited to rights under copyright, trademark, service mark or patent
laws under any relevant jurisdiction. No compensation will be paid with
respect to Microsoft's use of the materials contained within such
communication." (and yes, I double-checked the date of the article)

with Passport, at least according to the Microsoft documents I've seen, so
this could affect your company's copyrights, as well as any patent
discussions you hold via Passport/Hailstorm/.NET.

I read the material at Arlen's links, then asked one of our developers--the guy who is suggesting that we support the .Net platform. Here is what he said:

"I think the web site quoted below [... may be] off-base. When you communicate via
Hotmail, IM, or Hailstorm, none of your messages go through the passport
web site. Rather, those services contact Passport during an initial
security handshake. After that, Passport is out of the loop. I believe
that the rights Microsoft takes in the terms of use are only relevant to
things like support emails about your Passport account."

So we may, hopefully, be reasonably safe.


Ask a lawyer, not a developer. Developers are the guys who know software, not law.

And yes, under that agreement, you are passing your exclusive rights to the material to Microsoft.

Bill doesn't want to be dominant in the market, he wants to be Emperor of the Universe.

Under that type of agreement, I wonder if they are legally responsible for any pornography, etc, that may be stored there?
