I never said he would (or could or should) be held legally accountable, just that having an ambiguous test (or a seemingly-objective test which is evaluated subjectively) might *inspire* someone to file a lawsuit. Even when you win -- heck, even if you never get to court -- it's a huge hassle and a lot of money. Perhaps I'm just a pessimist when it comes to the lawsuit-happy population. :-)

I respectfully disagree, Tracy, unless the test was the sole criterion for
the job. If Andrew's test is just one of many criteria for evaluating an
individual's "qualifications," I find it difficult to believe that he could
be held legally accountable because someone didn't meet Andrew's
